  • What are the benefits of a land trust?

 

  1. Privacy is your main benefit. When you own properties in land trusts, there is no public record of your ownership, so no one knows who owns the property. This includes lawyers, ex-spouses, tax agencies and others. Because no one knows who owns the property, it's harder for them to take it.
  2. Avoiding lawsuits - we live in a very litigious society and lawyers are more likely to go after people with lots of real estate. If it doesn't look like you own a lot of property, it's less likely you will be sued.
  3. Avoiding liens - personal liens and judgements against you or other beneficiaries do not attach to the property.
  4. Avoiding probate - because you have named successor beneficiaries in your land trust, your trust property will go directly to whomever you name immediately without going through the probate process.
  5. Keep price secret - you can keep the purchase and/or sale price of property in a land trust secret from any prying eyes


  • Who owns the land trust? 

             The beneficiaries own the land trust. 


  • How do I set up a land trust?

  • Can I deed more than one property in a land trust? 

             You can, but we don't recommend this because there's the greater 

             possibility of attaching more than one property in a lawsuit, similar to 

             the result of a lawsuit with more than one property in a LLC. 


  • What is the beneficiary?

             This is the actual person or entity that owns the property in the land 

             trust.

  

  • What is the trustee?  

             This is the actual person or entity whose name the property is titled. 

             The trustee can only act on written instructions from the beneficiaries. 

 

  • What is the successor beneficiary?

             This is the person who will replace the beneficiary in the land trust 

             when the initial beneficiary dies. 


  • What affect does a land trust have on my taxes?

             A land trust is not a recognizable entity by the IRS. The taxes fall 

             through to the beneficiaries. 


  • Can I be my own trustee?

             The beneficiary and the trustee cannot be the same name or entity
